With the creation of a Trust, you may also wish to appoint a protector of the trust (“Protector”) to ensure that the wishes of the Settlor and the interests of the Beneficiary(ies) are both considered and protected.
The role and responsibilities of the Protector are typically set out in the Trust Deed and may include:
- advising the Trustee in relation to the exercise of its powers;
- the power to consent to or veto certain transactions or actions of the Trustee;
- the power to appoint or remove the Trustee.
Our experience shows that an independent authorised representative is best suited for the position of the Protector as it will help to avoid conflicts of interest and provide additional comfort to the Settlor.
